The acquittal of one charged with adultery in which he testified that he had not had sexual intercourse with the woman involved, bars a prosecution against him for perjury in so testifying in the adultery cause.81

But the innocence of an accused, in which a witness testified for him, is no defense to a charge of perjury.82
