Under statutes as well as the common law, the real essence of the offense is malice toward the owner of the animal killed or injured.304 To constitute the offense it must appear that the injury was done out of a spirit of cruelty, hostility or revenge. The doing of an unlawful act wilfully without excuse, though ordinarily sufficient to establish criminal intent, is not alone sufficient under some statutes.305
