An allegation that defendant agreed to pay 5 per cent. on the amount for which he should sell the mill of defendant, whatever it might amount to, is not sustained by evidence that defendant agreed to pay plaintiff 5 per cent. if he would sell the mill for $5,000; and this forms a fatal variance between the contract declared on and that proved.
