Where a lender negligently paid the draft of a broker employed to procure a loan, the proceeds of which were converted to the broker's own use, the borrower was entitled to a cancellation of his note and mortgage. Robinson v. Citizens' Trust Co., 172 S. W. 1160, 187 Mo. App. 51.
