Question 198. - (a) A customer of bank X takes a note from B. made payable at bank X, but does not leave it for collection. On due date promissor calls at bank to pay note and is told it is not there. Does this have any bearing on promissor's obligation to pay after due date?

Answer. - (a) Omission to present the note at maturity at the place where it is payable does not discharge the maker, but. payment having been tendered there, interest would cease to accrue and in any suit commenced against him before actual presentment was made costs would be at the discretion of the Court. It has been held that it is the maker's duty to have the payment at the place of domicile when the note matures and, if the note is not there, to leave the payment there to await presentation.
