Question 326. - A cheque is presented at a bank for payment and is dishonoured for reason "( N. S. F.," and protested. Later funds are provided sufficient to cover the cheque, and protest fees, and the cheque is again presented. Should the drawer bank pay the cheque for face amount only, or for the amount, plus protest fees?

Answer. - Section 113 of the Bills of Exchange Act allows a holder to protest a cheque if he sees fit, and section 121 provides that the expense of protesting shall be paid to him, but as the duty of the drawee bank is to comply with the order of the drawer it is not required to pay more than the face value of the cheque without instructions from the drawer to do so.
